In December 2011, the Department of Justice issued its annual press release of recoveries from contract fraud serving as a reminder of the risks of being a government contractor and reinforcing the importance of knowing the expectations for Business Ethics and Standards of Conduct.

These requirements are embedded within every government contract through FAR Part 52 clauses which invoke FAR Part 3, Improper Business Practices and Personal Conflicts of Interest as well as sections of FAR Part 9 which address Debarment, Suspension and Ineligibility as well as Organizational Conflicts of Interests. This presentation will be a non-legal perspective of these provisions including DCAA (Defense Contract Audit Agency) policies which implicate their consideration of fraud within their contract audits.
